Terms & Conditions of Booking (Rental Rules)







 

Definitions:

  • the booker - the guest (non-corporate bookings) or the company (corporate bookings) making the booking

  • guest(s) – person(s) named on the booking

  • the booking party - all guests named on the booking, including any guests substituted or added at a later date and confirmed in writing with us

  • you / your / yourself - the booker and the booking party collectively  

  • Acacia Stays / we / us / our - Maureen Tiernan trading as Acacia Stays

  • the property - the accommodation booked

 

Thank you for booking with Acacia Stays. We look forward to welcoming you to stay at the property.

 

Acceptance of Terms and Conditions 

These Terms and Conditions govern all bookings made with Acacia Stays. The booker certifies that they are authorised to agree to the Terms and Conditions on behalf of the booking party. The booking party shall likewise observe the Terms and Conditions. The booker agrees to take responsibility for the booking party. Payment of the booking fee also constitutes acceptance of these Terms and Conditions. Please read them carefully as they contain important information regarding the booking party’s stay.

 

Payment and Booking Confirmation

Bookings can be placed via the website, via email: bookings@acaciastays.co.uk or via telephone: 07763 233 658

The booker must provide the following verification at the time of booking:

  • For corporate bookings: the company name, company number, registered address and telephone number, in addition to the full names of the booking party and the mobile number of at least one guest

  • For non-corporate bookings:

    • Photo ID of the booker (current driving licence / passport page) their current address and mobile telephone number, in addition to the full name of each adult guest and the total number of minors in the booking party

    • Where the booking party is made up of individuals as opposed to a family, confirmation that all adults in the booking party are aged 25yrs and over

 

Payment Methods:

The full price of the booking is due at the time of booking. Payment can be made via bank transfer, credit/debit card, or other methods as specified during booking. Payments must be in cleared funds before the booking is confirmed. Credit card details must match the security checks. We may pass your debit/credit card details to Stripe to process payments: a transaction fee will be charged on all credit card payments but there is no transaction fee on debit card payments. Credit card fees are non-refundable in any circumstances.

 

Booking Confirmation:

A booking is only confirmed at the point when, after receipt of payment in full and successful completion of ID verification checks, we issue Booking Confirmation in writing to the booker.

 

Security Deposit

We require a £250 security deposit on all bookings.  Where paying by credit\debit card, this will be requested as a card pre-authorisation the day before arrival. Valid credit/debit card details must be supplied at the time of booking. Failure to provide card details may result in access details to the property being withheld. The security deposit will go towards any additional charges including without limitation - breakages, damages, extra cleaning and/or any breach of these Terms and Conditions. By placing a booking, you authorise us to deduct such payment from the Security Deposit.  Should charges for any breach, negligent performance or non-performance of these Terms and Conditions exceed the security deposit or the amount recoverable from the registered card, you are liable to cover all reasonable liabilities and making good.

 

Cancellations

By you:

  • Cancellations notified more than 2 weeks before check-in date: a 100% refund of the booking fee will be issued

  • Cancellations notified at least 1 week and up to 2 weeks before check-in date: a 50% refund of the booking fee will be issued

  • Cancellations notified 1 week or less before check-in date: no refund will be issued

  • No-show: you are liable for the full cost of the booking

 

By us:  

  • We would only cancel your booking if the property was unavailable for reasons beyond our control. Our liability in this respect would only extend to refunding the amount(s) you have already paid to us.

Check-In

The property will be made available to the booking party from 4pm on the check-in date, unless otherwise requested and we have confirmed our agreement in writing at least a day before arrival.

 

Check-Out

The property must be vacated by 10am on the check-out date. Requests for late check-out will be considered on a case-by-case basis and must be made in writing and agreed by us in writing at least one day before check-out. We charge for agreed late check-outs at a rate of £25 per hour or part thereof.

If the booking party exceed a check-out time without our prior written agreement, we have the right to charge you for any unauthorised overstay at a rate of £50 per hour or part thereof.

 

Condition

The property will have been cleaned by a professional cleaning company prior to your arrival. You undertake to notify us at your earliest convenience should you notice inadequate cleaning, so that we may endeavour to rectify the situation. You undertake not to move anything from the property and to leave the property in a clean, tidy and damage free condition on departure with all windows closed and all doors locked.

 

Occupancy

You agree to ensure that the maximum occupancy of six persons for the property is not exceeded. Only the booking party have the right to enter onto or stay in the property. If additional unauthorised persons enter onto or stay in the property, you will be liable for all additional persons at a charge of double the nightly rate that would have applied at the time of booking, for each night they stay.

 

Children

We welcome children of all ages. If you require a travel cot or highchair, we must be notified of this at the time of booking. Charges may be applied to supply these items to the property, if requested at short notice, or during the booking.

 

Guest Conduct

House Rules:

The booking party undertakes: to follow the House Rules and any instructions set out within the Welcome Guide, to observe any safety notices at the property, to behave responsibly and to respect our neighbours and the property. We have a duty of care to our neighbours and community and as such we do not tolerate any anti-social or unacceptable behaviour. The booking party are not permitted to use the property for any dangerous, offensive, illegal or immoral purposes.

 

Noise / disturbance:

The property is fitted with a noise monitor. The booking party must not cause any noise disturbance and must respect quiet hours between 9pm and 9am. On receipt of any complaint or notification of loud noise / disturbance, we will first reach out to politely request that the booking party keep the noise down. If warnings are disregarded, we have the right to alert our security team and/or the police to intervene on our behalf and you will be held liable for any costs incurred.

 

Stag / Hen party bookings and/or other forms of party/gathering/ event:

Strictly no stag/hen party is permitted to stay/take place at the property. Nor is any other form of party/gathering/event permitted at the property. If we suspect that a booking has been made for a stag/hen party and/or other form of party/gathering/event, we have the right to ask additional questions to confirm this, which may result in the booking being cancelled.

 

Pets:

Strictly no pets are allowed on or in the property. A surcharge of £100 will be made if evidence of a pet is discovered.

 

Smoking / Vaping / Illegal Substances:

Strictly no smoking / vaping / illegal substances are allowed inside the property. A surcharge of £100 will be made if evidence of smoking/vaping / illegal substances is discovered.

 

Candles / Flames:

Strictly no candles, incense sticks or open flames or any kind.

 

Termination / Eviction

We reserve the right to terminate your stay without notice if any of these Terms and Conditions are breached. No refunds will be provided, and additional surcharges may apply. In exercising our right to evict, if we need to alert our security team and/or call the police to intervene on our behalf, you will be held liable for all costs incurred. You will also be held liable for all and any additional costs we incur as a result of our fire compliance and/or insurance being invalidated by you.

 

Damages, breakages and missing items

Please take care when staying at the property. You are liable for any breakages or damages to the property and/or its contents, which has occurred accidentally or due to negligence, wilful damage or irresponsible behaviour on the part of the booking party and/or any unauthorised persons. You are also liable for any items removed from the property.

  

Please report any incidents as and when they occur.  You will be held liable for the full costs of replacement, repair and/or making good and will incur an additional surcharge of £50.00 if you failed to make such a report.

Should charges for any damages and/or breakages caused and/or missing items exceed the security deposit or the amount recoverable from the registered card, you are liable to cover all reasonable liabilities and making good, in connection with the damages/breakages caused and items removed. Any costs that we reasonably incur as a result of total costs exceeding the amount of the security deposit, must be paid by you within 7 days of our request for payment

 

Security of Tenure

You agree that the property is occupied and used as serviced accommodation only. No relationship of landlord and tenant is created and no statutory security of tenure or right for you to remain in the property exists now or at the end of the booking period. These conditions constitute an excluded agreement under S(3A)(7) (a) of the Protection from Eviction Act 1977 (as amended).

 

Liability and Insurance

You are responsible for your own safety and for securing and insuring your vehicles, your contents and possessions. We do not accept any liability for any damage to or loss of, your vehicles or possessions, unless proven to be caused by a negligent act by us, our team, and/or our contractors.

 

You shall indemnify us against all liabilities, costs, expenses, damages and losses (including any direct or indirect consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other reasonable professional costs and expenses) suffered or incurred by us, arising out of or in connection with your breach or negligent performance or non-performance of these Terms and Conditions.

 

Other than in relation to death or personal injury caused by our negligence, or any other liability that by law cannot be excluded or restricted, our liability to you is limited to the value of the booking fees you have paid to us.

 

Rights of Access

Representatives of Acacia Stays and/or our subcontractors have the right of access to the property: if there is an unforeseen problem, to investigate any complaint you or another person has made, for the purpose of inspection of the property and to carry out any essential repair or maintenance work. If we do need to access the property for any reason, we will always endeavour to have due regard for the convenience of the booking party (other than in the event of an emergency and/or a suspected breach of these Terms and Conditions). You/your behaviour must not inhibit and/or endanger the safety of our staff or contractors.

 

Sub-letting

Strictly no re-letting or sub-letting to any other persons.

 

Services and Facilities

The property is advertised as providing a number of services, facilities and amenities. While every effort is made to this end, the availability and proper functioning of these cannot be guaranteed. We are not responsible for providing any refund or alternative provision of said service, facility or amenity and no refunds will be offered. Service outages can occur from time to time and no guarantee can be made as to the functionality of the internet connection or of other utilities. We accept no liability for any losses resulting from a loss of internet connection or utility service.

 

Toiletries and Condiments

Acacia Stays often (but without obligation) provides toiletries and condiments on arrival. These are complimentary and provided at the discretion of Acacia Stays. They will not be replenished during the booking party‘s stay:​

  • small supply of tea, coffee and sugar sachets

  • small amount of washing up liquid

  • 1 washing up brush

  • 2 laundry tablets

  • 1 surface wipe

  • 1 tea towel

  • 1 spare kitchen bin liner

  • salt and pepper

  • spray cooking oil

  • tin foil

  • 2 toilet rolls

  • handwash in the bathroom

  • shampoo and body wash in the bathroom

 

Promotional Emails and Content

You agree to receive from time to time promotional messages and materials from us by postal mail, email, text, telephone, social media platform or any other form of contact. If you don't want to receive such promotional materials or notices, email: info@acaciastays.co.uk

Complaints and Disputes

Any complaints should be reported immediately to us during your stay either via email: info@acaciastays.co.uk or via mobile: 07763 233658. We will attempt to resolve any issues as soon as practicable. Complaints reported after check-out may not be considered. In the event of a dispute, both parties agree to attempt mediation before pursuing legal action.

 

Data Protection

Any data collected during the course of this booking will be stored on our computers in accordance with the Data Protection Act 2018 and GDPR.  For full details, please refer to our Privacy Policy.

 

Events beyond our control

We cannot be held liable for cancellations or interruptions to your stay due to events beyond our control, including without limitation, fire, explosion, storm, flood, earthquake, subsidence, epidemic/pandemic or other natural disaster, strikes or industrial action by third parties, government restrictions, terrorist attack or threat of terrorist attack, war or threat or war, civil commotion, riot, invasion, or failure of public or private telecommunications network.

 

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the jurisdiction of the courts of England and Wales.

 

Severance

In the event that a court finds that any condition of these Terms and Conditions is illegal or void, the illegal or void provision(s) will be severed from the remainder of the Terms and Conditions which will continue to be valid and have full force and effect.
